Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of SaibaiNote, a home gardening management service ("Service") operated by Keita Takenouchi ("Operator"). By using the Service, you agree to be bound by these Terms.

2. Service Overview

SaibaiNote is a web application that helps you log and manage home garden cultivation. Features include cultivation diaries, photo uploads, weather recording, reminders, and cross-device data synchronisation.

3. Eligibility

The Service is intended for personal, non-commercial home gardening use. You must be at least 13 years old to use the Service. If you are under 13, please do not register or use the Service. Users outside Japan may use the Service provided they comply with the laws of their own jurisdiction.

4. Accounts and Guest Sessions

4.1 Guest Sessions

You may use the Service as a guest without registering. Guest session data is retained for 90 days after your last activity and is then automatically deleted. To retain data permanently, you must create an account.

4.2 Account Registration

Registration requires a valid email address and password. You are responsible for keeping your registration information accurate and your password confidential.

4.3 Account Security

You are responsible for all activity that occurs through your account. Please notify the Operator immediately if you become aware of any unauthorised use.

4.4 Account Deletion

You may delete your account at any time. Deletion is permanent and irreversible: all cultivation records, photos, and other data associated with your account will be permanently erased.

5. Prohibited Conduct

You agree not to:

• violate any applicable law or regulation;
• infringe any third-party intellectual property, privacy, or other rights;
• attempt to gain unauthorised access to the Service or its infrastructure;
• transmit spam, malware, or other harmful content;
• use the Service for commercial purposes without prior written consent;
• reverse-engineer or attempt to extract the source code of the Service;
• interfere with other users' enjoyment of the Service.

6. User Content

You retain ownership of all content you submit to the Service (photos, text, etc.). By submitting content, you grant the Operator a non-exclusive, royalty-free licence to use that content solely to the extent necessary to provide and improve the Service. The Operator will not sell your content to third parties.

7. Service Changes and Termination

The Operator may modify or discontinue the Service at any time without prior notice. The Operator is not liable for any loss arising from such changes or discontinuation.

8. Disclaimers

The Service is provided "as is" without warranty of any kind. The Operator makes no warranty as to the accuracy, completeness, or fitness for any particular purpose of the Service or any information provided through it (including cultivation advice). The Operator is not liable for service interruptions caused by events outside its control, including natural disasters, communication failures, or third-party cyberattacks.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator's total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim (zero for a free service).

10. Changes to These Terms

The Operator may update these Terms from time to time. Material changes will be announced within the Service or by other appropriate means before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
